("THE SITE"). BY USING THE SITE YOU AGREE THAT YOU HAVE READ AND ACCEPT THESE TERMS AND CONDIDTIONS AND THAT THEY SHALL APPLY TO YOUR USE. IF YOU DO NOT WISH TO BE BOUND BY THEM, PLEASE LEAVE THIS WEBSITE. This Agreement is made between you and Salvage Direct (registered number IE: 3952433) whose registered office is 24 Carnally Rd, Silverbridge, Newry, Co. Down, BT35 9LY. General Terms and Conditions This Agreement sets out the rights and obligations of Salvage Direct and all users of salvagedirect.ie this covers all items placed for auction on the Site. Rights To Suspend or Terminate. You agree that Salvage Direct, in its own discretion, may terminate any auction or use of the service immediately and without notice. Membership. Membership to this web-site is only available to those who can form a legally binding contract. We require the Members to provide their Dealer Code, a Photocopy of Photographic ID and one of the following:- Tax Clearance Cert Number, Waste Permit or Vat Registration Number. This web-site does not permit minors (under 18) to register. If any member fails to signup with their correct age the account will be terminated immediately. Your Conduct. You are solely responsible for the contents of your actions through this web-site. You must ensure that your participation in buying of items does not violate any applicable laws or regulations. By this we mean that you must check that you are entitled to buy the relevant item and that you are not prohibited from doing so by any law or regulation. You must not transmit through the service any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material. You must also not transmit any material that encourages conduct that could constitute a criminal offence, give rise to civil liability or otherwise violate any applicable law or regulation. Bidding in Auctions. The winning bid in any Auction will be the highest bid which exceeds any reserve. If a bid made by a member is followed by a higher bid by another member that is later removed by Salvage Direct for any reason, Salvage Direct may in its sole discretion decide whether to accept the previous highest unsuccessful bid as the Winning Bid. With this exception, all unsuccessful bids will lapse after closure of the relevant Auction. Bids are not retractable. If the member places the Winning Bid, and the member’s bid is accepted, then that member (the "Winning Bidder") shall be legally obligated to complete the transaction. Payment. Salvage Direct shall not make credit terms available to, or otherwise extend credit to members using salvagedirect.ie. The Winning Bidder shall be required to contact Salvage Direct and make confirmed payment in full and collect the vehicle within 10 calendar days (including day of auction closure) of the date of the auction closing (the "Payment and Collection Period"), and in any case before a Salvaged Vehicle will be released by Salvage Direct. Laws and jurisdiction. Where the Site and/or the Interactive Services are accessed from the Republic of Ireland, or outside the Republic of Ireland, this Agreement shall be governed by the laws of the Republic of Ireland and you hereby submit to the exclusive jurisdiction of the Irish courts.
